The phrase “Planning Permission” usually conjures up images of endless paperwork, waiting months for a decision, and the nagging fear of a rejection letter.

But what if you did not need it?

Many homeowners in England are surprised to learn they can significantly extend their property using Permitted Development (PD) rights. Think of PD as a “pre-approved” allowance from the government. It lets you skip the subjectivity of a full planning application—provided you follow the rules to the letter.

First: Do You Actually Have PD Rights?

Before you start measuring up your garden, you need to check your eligibility. PD rights are not automatic. You do not have these rights if:

  • You live in a flat or maisonette: PD applies to houses only.
  • Your home is a Listed Building: You will certainly need Listed Building Consent.
  • You are in a “Designated Area”: If you live in a Conservation Area, National Park, or AONB, your rights are heavily restricted (though not always entirely removed).
  • Your rights have been removed: Sometimes councils remove these rights on new build estates or specific streets using an “Article 4 Direction.”

What Can You Actually Build?

If you are eligible, the government allows for quite a bit of flexibility. Here are the most common projects we handle under Permitted Development:

  1. Rear Extensions

This is the most popular route for creating that dream open-plan kitchen.

  • The Standard Rule: You can extend up to 4m for a detached house, or 3m for semi-detached/terraced houses.
  • Height: Max height of 4m (or 3m if you are within 2m of a boundary).
  • The “Larger” Route: Need more space? You can actually double those depths (up to 8m and 6m) using the Prior Approval process. This triggers a quick consultation where the council checks if your neighbours object, but it is still faster than full planning.
  1. Loft Conversions

You can usually convert your loft without full planning if:

  • You do not exceed a volume allowance (40m³ for terraces, 50m³ for others).
  • You do not add dormers to the front of the house (Velux windows are fine).
  • You do not go higher than the existing roof ridge.
  1. Two-Storey Extensions

These are trickier, but possible. You cannot extend further than 3m from the rear wall, and you must be at least 7m away from the rear boundary. Crucially, strictly no side windows are allowed if they could overlook a neighbour.

  1. Garden Rooms & Offices

Perfect for working from home. These must be single-storey and “incidental” to the main house (i.e., you cannot use it as a bedroom or Airbnb). If you want to build it right up against the fence, keep the total height under 2.5m.

The “Golden Ticket”: Lawful Development Certificates

Here is the piece of advice we give every client: Get it in writing.

Even though you do not technically need to apply for permission, we strongly recommend applying for a Lawful Development Certificate.

This is an official document from the council proving your extension was legal at the time of construction. Without it, you might face a nightmare when you eventually try to sell your house, as solicitors will demand proof the work is compliant. It is a small cost for total peace of mind.
